Frequently Asked Questions
What is Conflict Coaching at Above Conflict?
Try our conflict conflict coaching sessions to help work through a conflict or issue one-on-one. Or to decide whether mediation is the right next step for you. Conflict Coaching at Above Conflict is provided in an individualized appointment where you work with a Conflict Coach to discuss and identify the issues, and learn conflict resolution techniques. To answer what is Conflict Coaching, it is also helpful to define what it is not. Conflict Coaching is not therapy. Conflict Coaching is not legal advice. And a Conflict Coach does not solve the problem for you. Instead, when you are looking to speak to someone privately about a difficulty, struggle, or problem you are facing, a Conflict Coach at Above conflict can be a good place to start. After your conflict coaching session(s), some individuals with a problem involving another person, may even decide that the issue is suitable for mediation, and may opt for our help in initiating a mediation process.
What is mediation at Above Conflict?
Mediation is a voluntary conflict resolution process where a neutral third party (the mediator) helps two or more parties (people) in facilitating their negotiated outcome/agreement. In your mediation at Above Conflict, a neutral professional (mediator) helps facilitate your resolution to a conflict. The mediator as the neutral third-party, helps facilitate the parties' conversation and their negotiated agreements. You (the parties) decide what the goal is for your mediation, and whether or not it is a mutually satisfactory agreement. Again, to define mediation, it is also helpful to define, what it is not. Mediation is not a judicial process.
At Above Conflict, what do you like about mediation?
Mediation can be used at any stage of a problem! It can be used to strengthen strained personal and professional relationships, address issues and conflicts informally, and it may even be utilized for cases filed in Court. Mediation is a voluntary process and creates a space for creative solutions. Some people find mediation to be less contentious and more cost-effective. Some people find mediation takes less time then going to Court. Unlike a Court case that is public, a mediation is private and a mediator will discuss with you what Confidentiality means in a mediation.
What is an Attorney-Mediator?
An attorney and a mediator are two separate roles/professions. You do not need to be an attorney to be mediator. Many mediators are not attorneys. However, a mediator who also has the experience and education/skills of an attorney, and works as a mediator instead of an attorney, can be called an Attorney-Mediator. The Attorney-Mediator, having the education and skills of both an attorney and mediator, instead of of providing legal or advocacy services, provides neutral mediation services. An Attorney-Mediator can utilize their prior legal education, training, and experience, to better their (the Attorney-Mediator's) understanding of the concerns and issues involved in the mediation. The Attorney-Mediator is a neutral third-party who facilitates the parties negotiations during the mediation.
What does it mean to be a Neutral?
Sometimes you may hear or read the words Neutral and Mediator or Third-Party Neutral used interchangeably at Above Conflict. In short, it means that the professional is not there to advocate or take any sides.
